Victorian arsenic positive sample runners disqualified

In accordance with the provisions of AR 177, the Victorian RAD Board on Tuesday made the following orders in relation to the horses Guilty as Charged, Spirit or Lager, Prince of Oz and Hairini Tycoon. AR 177 provides that:

‘Subject to AR 177C, any horse that has been brought to a racecourse and a prohibited substance is detected in any sample taken from it prior to or following its running in any race must be disqualified from any race in which it started on that day.’

Guilty as Charged

A prohibited substance, being arsenic in excess of 0.30 milligrams per litre in urine, was detected in a post-race urine sample taken from the Stephen Theodore trained Guilty as Charged following its win in Race 1 at Geelong on 29 May 2015.

Pursuant to AR 177, Guilty as Charged must be and is disqualified as the winner of that race and the placings amended accordingly.

Spirit or Lager

A prohibited substance, being arsenic in excess of 0.30 milligrams per litre in urine, was detected in a post-race urine sample taken from the Gareth Andrews trained Spirit or Lager following its wins in Race 8 at Geelong on 12 June 2015 and Race 9 at Pakenham on 3 July 2015.

Pursuant to AR 177, Spirit or Lager must be and is disqualified as the winner of the abovementioned races and the placings amended accordingly.

Prince of Oz

A prohibited substance, being arsenic in excess of 0.30 milligrams per litre in urine, was detected in a post-race urine sample taken from the Kelvin Southey trained Prince of Oz following its running in Race 7 at Geelong on 30 June 2015.

Pursuant to AR 177, Prince of Oz must be and is disqualified as 8th place-getter in that race and the placings amended accordingly.

Hairini Tycoon

A prohibited substance, being arsenic in excess of 0.30 milligrams per litre in urine, was detected in a post-race urine sample taken from the Shea Reynolds trained Hairini Tycoon following its win in Race 5 at Bairnsdale on 18 August 2015.

Pursuant to AR 177, Hairini Tycoon must be and is disqualified as the winner of that race and the placings amended accordingly.
