RV stewards' charge syndication company and its directors over non disclosure of relevant interest in Product Disclosure Statements

Racing Victoria (RV) Stewards advised on Tuesday that they have issued three charges against First Light Racing Pty Ltd (First Light Racing), and four charges to each of its directors, Tim Wilson and Sam Kilkenny, following an investigation into the promotion and syndication of horses in accordance with regulations imposed upon them as an approved Syndicate Promoter.

The charges relate to the failure of First Light Racing, and its directors, to disclose any relevant (actual or perceived) conflict of interest in its Product Disclosure Statements.

First Light Racing

Charge 1 and 2 – 175gg – False or misleading statement or declaration.

AR 175 States that the Principal Racing Authority (or the Stewards exercising powers delegated to them) may penalise:

(gg) Any person who makes any false or misleading statement or declaration in respect of any matter in connection with the administration or control of racing.

Charge 3 – 175A – Conduct prejudicial to the image, interests or welfare of racing.

AR175A states that; Any person bound by these Rules who either within a racecourse or elsewhere in the opinion of the Principal Racing Authority (or the Stewards exercising powers delegated to them) has been guilty of conduct prejudicial to the image, or interests, or welfare of racing may be penalised.

Tim Wilson

Charge 1 and 3 – improper, dishonest and/or dishonourable action or practice.

AR175 states that the Principal Racing Authority (or the Stewards exercising powers delegated to them) may penalise:
……
(a) Any person, who, in their opinion, has been guilty of any dishonest, corrupt, fraudulent, improper or dishonourable action or practice in connection with racing.

Charge 2 and 4 – 175(gg) - False or misleading statement or declaration.

AR 175 states that the Principal Racing Authority (or the Stewards exercising powers delegated to them) may penalise:

Sam Kilkenny
